This employee was a 52 year old married man with a high school education; who had been working as a welding foreman. He first hurt his back in 1990. He underwent his first surgery in the early 1990's and, unfortunately, two weeks after the surgery he sneezed and re-injured his back thereby having to undergo a second back operation. He was out of work for approximately six months in the 1990's and then returned to work full duty with no problems for this employer.

Unfortunately, in 1998, he sustained his first industrial accident while working for his current employer. At that time, there was a fire in the building and, in the panic, he grabbed a pallet that weighed 600 lbs. to try and move it and injured his low back. He actually continued working after that injury for approximately a year and a half undergoing injections as well as pain medications and physical therapy. Unfortunately, he had to undergo back surgery once again in March 2000. He was out only two months and returned to work light duty for two weeks. He then went full duty full time and has continued doing that since the 1998 injury until 2003. In 2003, he was pushing a cart full of steel that weighed approximately 600lbs. while another employee was pulling and he felt a surge of pain in his low back radiating into his right leg. He subsequently had three additional back surgeries which all failed.

This employee exhausted his temporary total disability benefits and a Court Order was son placing him on permanent and total disability benefits under §34A. This Order was appealed by the insurer and an impartial examination was conducted by a state hired physician, based upon the strength of this report this employee's worker's compensation claim was settled for $250,000.00, and his medical bills will be paid by the insurer for the rest of his life. Moreover, he was successfully placed on Social Security Disability benefits which were no longer offset after the worker's compensation settlement.

This 46 years old employee was a native of Puerto Rico and had been employed as a janitor/maintenance person for approximately 15 hours per week for about four years at a Framingham, Massachusetts company. He was also concurrently employed working a second job. He had a combined average weekly wage of $760.00.

While in the course of his employment, he was bringing some trash bags, that were loaded in a cart, out to the dumpster. The cart was overloaded and when he went to take one of the trash bags out to put it in the other cart, the trash bag began to flop and he fell and injured his entire right side. This employee continued to work, both jobs, with great difficulties and pain, for six months after the accident. He then underwent surgery with a Natick, MA doctor, for his right wrist. This employee was 51 years old at the time of his industrial accident which occurred in Milford, Massachusetts, when he was trying to manipulate a 260 iron bar he was carrying, he lost his balance, and suffered a severe injury to his low back. He eventually underwent a laminectomy and fusion at L4/5 and S1 at a Boston Hospital. The employee, who was in her 50's at the time of the accident, was a native of Greece, had a seventh grade education in her home country. This 69 year old male employee with one dependent, his wife, had been employed as a truck driver for approximately 30 years. This 56 year old male employee from Marlboro, MA, with one dependent, his wife, has a GED and was in the United State Army, as a Missile Technician for five years in the 1960's.

This employee was a truck driver for many years and eventually became a mechanic for New England Frozen Food in Framingham, MA. Initially, he was employed as a truck driver involved in loading and unloading of frozen food and ice cream. In 1980, he became a mechanic initially on the truck refrigeration units and eventually on all aspects of the entire trucks; and in 1981 he became a working foreman with a crew of five responsible for a hundred sixty-five trucks

Unfortunately, he sustained a lower back injury in 1976 requiring surgery, and was out of work for approximately four months. In 1980, he had further surgery, following an industrial incident, and was out of work approximately four months again. In 1989, he had a third surgery and he was out of work for several months. In 1991, he had another industrial incident with lost time amounting to several days, and finally, in August of 1991, the employee injured his back again at work, and has not worked since.

Initially, the self insurer contested liability as well as the extent of disability and the employee went in front of an administrative judge at the Boston Department of Industrial Accidents who ordered him on a temp total compensation. After an appeal by the insurer, a hearing decision was issued, which found the employee to be only partially disabled, and awarded the employee an earning capacity of $400.00 dollars.

The employee then filed a claim to increase his benefits to permanent and total disability benefits. Prior to going forward at Hearing at the Boston Department of Industrial Accidents the case settled for $165,500.00. The employee's medical benefits remain open for the rest of his life.

Motor Vehicle Accident with Brain Injury

This 30 year old plaintiff from Chelmsford, Massachusetts was a driver on Route 3 North, in Billerica, Massachusetts. While driving in the left lane, she encountered heavy traffic and slowed to accommodate same. This teenage plaintiff was a passenger on her boyfriend's motorcycle traveling westbound on Route 9 in Wellesley, MA. Another vehicle traveling eastbound on Route 9 in Wellesley, MA attempted to make an illegal U-Turn in front of them, thereby hitting their motorcycle and throwing both the driver and the passenger into the air. She was taken by ambulance to a Boston Hospital where she was treated and released. She sustained soft tissue orthopedic injuries, but also road burn injuries which were permanent. This plaintiff who was from Bellingham, MA was motorcycling with friends in Burlington, VT. As the group of motorcyclists took a corner, on of them lost control of his bike thereby causing the plaintiff to pushed off the road. He injured his knee in the accident and was seen in a Framingham, MA hospital the day after the accident. He was eventually diagnosed with a torn medial meniscus and ACL tear. The female plaintiff, age 28 was exiting her apartment building in Framingham, Massachusetts, when she slipped and fell on ice that accumulated on her building's entrance/exit. The plaintiff fell and broke her right wrist. The plaintiff presented immediately to the emergency room where she was placed in a shorts arm cast. Over the next several months, the Plaintiff attended doctor's appointments and physical therapy. The plaintiff accumulated $12,220.00 in medical bills. Shortly, after the plaintiff completed her treatment, we sent a letter demanding payment for medical bills and pain and suffering. In January of 2008, the claim settled for $40,000.00 for pain and suffering in addition to $12,220.00 for the plaintiff's medical costs.

This plaintiff was in his early 30's at the time of this motor vehicle accident which occurred in Framingham, MA. He was in a T-Bone accident and his vehicle was totaled as a result of the impact. He was taken by ambulance to a local Framingham, MA hospital where he was treated and released.

He had been in a prior motor vehicle accident a few years before this accident in which he had herniated two lumbar discs. The Plaintiff, a 50 year old mother of four grown sons who resided in Mendon, Massachusetts suffered a dog bite to her hand and breast when she was attacked by a pit bull while a guest at the dog owners' home in Marshfield, Massachusetts. The Plaintiff suffered from numerous lacerations, a large bruise and a permanent cyst. It was revealed the pit bull had previously attacked an interior decorator, maintenance worker, an elderly house guest and another dog. The subject pit bull was subsequently ordered to leave the town of Marshfield, Massachusetts by vote of the Board of Selectman. The order of the Board of Selectman was upheld in Plymouth District Court.

Social Security Disability/Award of Benefits to Claimant's Widower

The Claimant, a resident of the City of Worcester, had long suffered from severe degenerative disc disease in her back and a nervous disorder. She was denied Social Security Disability benefits twice by the Social Security Administration. Shortly before a Hearing before an Administrative Judge was to take place, the Claimant passed away from her illnesses. She left a husband who was struggling to get by financially. A Hearing was held with an Administrative Judge, at the Worcester Office of Hearings and Appeals, and an award of nearly 3 years of retroactive benefits was issued.

Social Security Disability Award of Benefits for Disabled Child and Parent

The firm represented two members of a Framingham family who both suffered from severe disabilities. The child, a 12 year old with severe developmental and learning disabilities was found to be disabled by the Social Security Administration. A 44 year resident of Ashland who suffered from uncontrollable seizures was awarded Social Security Benefits after under going a temporal lobectomy. The temporal lobectomy, brain surgery, was required to correct the epileptic seizures he suffered. Before undergoing this medical procedure the Claimant held a high level job and held a Masters of Business Administration degree. The Claimant was twice denied for benefits. As the matter was pending a Hearing, the Administrative Law Judge issued a fully favorable decision, without the need for a Hearing. The Claimant was awarded 2 years of retroactive benefits, retroactively to the date he stopped working.

Social Security Disability Awarded/Multilevel Fusion Surgery

The Claimant, a delivery driver for DHL in Shrewsbury, Massachusetts, was 37 years old when he suffered a debilitating back injury lifting heavy packages. Although the Claimant went through a course of physical therapy an injection, he ultimately underwent a two level fusion of his spine. Unfortunately, the fusion surgery did not completely resolve the back pain and increased the limitations the Claimant had on lifting and range of motion. The Claimant was denied by the Social Security Administration on his initial application, he was approved for benefits on his Reconsideration Request, with a Federal Reviewing Official. The Claimant was awarded approximately two years of retroactive benefits.

Social Security Overpayment/Overpayment Waived at Hearing

The Claimant, a resident of Needham, Massachusetts, originally injured himself when he fell 27 feet into the chase of chimney while repairing the chimney from a rooftop of a residential home in Marlborough, Massachusetts. He was awarded Social Security benefits and also received workers' compensation benefits. Without any notice he was required to do anything, Social Security sent a notice indicating that the Claimant had been overpaid in excess of $60,000.00. Through diligent research and documentation the firm was able to reduce the alleged over payment to less than $10,000.00. In addition an Appeal of the overpayment was prosecuted and brought before an Administrative Law Judge for a Hearing. At Hearing the Judge waived the overpayment, clearing the Claimant of any debt owed to Social Security.

Social Security Overpayment/Overpayment Waived for Claimant who Returned to Fulltime Employment.

The Claimant, a 59 year old, divorced mother of two college aged children from Northborough, Massachusetts was accused of receiving an overpayment in excess of $28,000.00 in Social Security benefits. The Claimant had been on Social Security Disability for a panic disorder, acute agoraphobia and bi-polar disorder. Despite a severe disability and the recommendation of her treating doctors, the Claimant fought her way back to full time employment. The Social Security Administration did not properly offset the Claimant income with her impairment related work expenses and miscalculated an overpayment. The effect of the miscalculation also caused the Social Security Administration to misapply the Claimant's trial work period and period of Extended Eligibility. The matter was appealed an Administrative Law Judge. At Hearing the Administrative Law Judge determined there was no evidence of an overpayment and that the Claimant had in fact been denied payments she was due. The Administrative judge praised and encouraged the Claimant in her struggle to remain in the work place despite a severe and ongoing disability.
